摘 要: “谢绝自带酒水”问题的争议由来已久,似乎从它诞生的那天起就备受争议。社会不同阶层的人们对饭店业“谢绝自带酒水”问题提出了各自的 看法,各省市对是否允许饭店谢绝消费者自带酒水都有着不同的观点。本文结合我国的消费者权益保护法、价格法和国际惯例对我国饭店“谢绝自带酒水”这一行为的合法性进行了分析,探讨了消费者与经营者的权利义务关系,阐述了市场监督管理部门的职能，并且指出了新形势下加强立法的重要性等，以期引导大家对该问题达成理性的认识。

Abstract: "Declined own drinks," the long-standing dispute, it seems that from the day it was born,the controversy never stoped. Different social strata of the people of the hotel industry, put forward their own views on "declined own drinks"。Every province and city have a different point of view on whether allowing consumers bring their own drinks to the restaurant
or not. This article, analysed the legality of it in the light of China's Law on the Protection of the interests of consumers, the price law and international practice,and discussed the relationship between rights and obligations of business and consumers , elaborate the functions of the market supervision management , and pointed out the importance of strengthening legislation which under the new situation, such , in order to guide people getting a rational understanding on this issue .
