本文研究将从我国广告业在整体社会经济环境下的大背景入手,提出治理虚假广告的必要性和紧迫性,并结合理论界及法律范畴对于虚假广告的定义,在分析其类型、构成及各种表现形式的基础上,将其与其他类型广告相比较、区分,对虚假广告的定义进行系统化和理论性的归纳,提出自己较为全面并且合理的界定方式。文章将结合当今虚假广告发展的现状,进一步阐释虚假广告对于我国市场经济体系构成的各种危害,通过现象分析及具体案例从相关法律的制定、企业行为、广告公司及媒体行业对其认知及消费者维权意识等各方面,探究造成虚假广告的各种原因,分析其所造成各种危害,进一步反映规范广告伦理及治理虚假广告的重要性。最终,本文将通过对虚假广告的客体及主体两方面的分析,结合造成虚假广告泛滥和治理不当的原因,在原有的结论上进行扩充,从法律因素、企业的短期行为、消费者的幼稚轻信、广告公司和传媒的听任放纵及名人不负责任的代言态度等多个角度归纳出相对合理的管理策略及解决方案,重新定位各机构、产业和在防止和控制虚假广告上的位置及应采取的措施,为改善虚假广告泛滥的现状提出自己的解决方案,旨在把以往的观点从理论的层面上提升到可实施性的高度,在一定程度上帮助广告市场重塑良好竞争秩序。
