我国目前资格刑完善的理论思考
—从剥夺政治权利角度分析

[摘 要]资格刑是以剥夺犯罪人的某种资格的刑法，通过剥夺行为人实施某种行为的资格和能力，彰显其实现刑罚特殊预防目的的独特功能。目前我国的资格刑种类简单并且针对性不强，剥夺政治权利的内容不尽合理。通过对我国及国外资格刑的理论研究，提出我国资格刑的合理界定。首先，在思想观念上应该排除过去那种太过于注重政治化的思想观念。其次，应当在资格刑的内容体系上予以完善，并严格规定各种资格刑的适用条件，如实行资格刑的非政治化。增加新的资格刑内容，除参考国外关于资格刑的相关规定外，最为重要的是增加剥夺特定职业权即剥夺犯罪分子从事某种特定职业或生产经营方面的权利、吊销或禁止授予驾驶执照的规定。有利于预防和惩罚犯罪的发生，有利于在立法观念上弱化其政治色彩，增强实用性和规范性，实现法的价值和终极目的。[1]
