改革开放30年，中国社会经济发展突飞猛进，中国社会越来越向国际化靠拢。随着社会的发展，人们的思想观念的更新与开放，近年来，非婚同居现象在日益宽容的社会环境下出现了与日俱增的发展态势。目前，老年人非婚同居在我国较大范围内存在，并逐渐成为一种普遍的社会现象。由于我国现行法律对于老年人非婚同居关系并没有明确的规定，也没有对老年人非婚同居行为进行严格的调整和规范，所以，在没有法律规制的情况下，由非婚同居引起的人身纠纷、财产纠纷也有增多的趋势。这种现象同时也说明，非婚同居问题已经成为迫切需要解决的社会问题之一。本文针对我国非婚同居立法的不足，从老年人非婚同居现象入手，对老年同居的基本问题进行阐述，由此引出我国现行婚姻家庭法律制度对于非婚同居的规制存在缺陷，最后结合国外对非婚同居行为的立法趋势及立法理论，针对我国的非婚同居提出立法构想。
