摘要：性贿赂是现在人们较关注的贿赂形式之一，其造成的社会危害与社会负面影响都在日益增加。有鉴于此，性贿赂是否立法的问题也是历来争论不休的一个问题。近年来，要求在刑法中增设“性贿赂犯罪”的呼声日益高涨，无论在理论界还是社会上，目前认为性贿赂应当立法的人都占有强势，但要把一个社会行为上升到立法的高度，必然需要严肃认真的就相关法理以及社会现实作进一步的探讨。本文将对支持性贿赂立法的观点进行思考、论述与反驳，为性贿赂不应立法找到足够的依据。
