【摘要】在经济全球化和市场一体化的大背景下，各国纷纷赋予本国反垄断法域外效力，以保护本国的利益。我国《反垄断法》第二条第二项适时对反垄断法的域外适用做出规定，是非常及时和必要的，是顺应潮流和趋势之举。但立法之后的问题也应引起我们高度重视。为此，笔者对反垄断法域外适用的原则以及西方国家相关立法与实践进行了分析与研究，在此基础上观察了我国反垄断法域外适用的缺陷与可能遇到的问题，并就相关问题提出了一些完善建议。

Abstract: under the grand background of the economic globalization and the market integration, more and more nations begin to authorize the Anti-trust law with the force of extraterritorial application. The provision of Paragraph 2 Article 2 of our country’s Anti-trust law that authorizes this law with the force of extraterritorial application is quite prompt, necessary, and also matches the modern current. But the problems after the legislation shall also be highly attended to. As to these matters, the author researched and analyzed the principles of the extraterritorial application of Anti-trust law and the relevant legislation and the practices. On this basis, the author observed the defects and possible problems of our country’s extraterritorial application of the Anti-trust law and raised some suggestions for addressing the relevant issues.
