摘 要
法与道德的关系在法学家那里一度成为主要的论题。而在我们所熟悉的上一个世纪，庞德的社会学法理学的兴起为我们探讨这个论题提供了一个转换的角度和立场——即那种以利益论为支撑的，强调社会控制的那种功能态势的视角。而本文以此为理论资源，首先就庞德对法律与道德的概念进行了分析。法律具有三种含义，这三种含义中法律秩序被看作为法律的第一种意义来首要使用，更直接意指法律。而道德则可以区分为道德规范和道德惯例。在这一基础上，辨析法律与道德的关系遵循庞德提出的历史的、哲理的、分析的和社会学的四条路径进行，继而从庞德对法律的产生与发展所划分的五个阶段来分析此二者的关系。而作为社会控制的法律与道德，本文对庞德的社会控制观进行了阐述，并从社会控制的角度分析法律与道德。最后，就法律与道德的社会控制性从两个方面进行思考，第一个方面在社会控制的层面，第二个方面则是安全。
