求正解!只知道固定搭配give up doing,为什么在这里不能用?

We communicated honestly,but he insisted that he !(is)! right.
前面insist用过去时,为什么后面用is?
第一道题不能用smoking!

smoke n. 烟,无常的事物,抽烟v. 吸烟,以烟熏,冒烟
give up doing/sth “放弃/戒掉/停止。。。”
