随着社会的不断进步和时代的不断发展，人民物质生活水平的提高，离婚案件越来越多，而夫妻离婚时共同财产的分割问题，已经成为现实生活中离婚纠纷案件最核心的问题。在实践中如何对离婚案件的夫妻共同财产进行认定和处理，关系到人民法院处理离婚纠纷的质量，关系到社会的安定团结和经济建设的顺利进行。但是法律在离婚夫妻共同财产分割方面的规定不够详尽，现行夫妻共同财产制度以现实的有形财产为主，无形财产往往被忽略，且在分割原则和分割方法上存在缺陷。本篇论文针对我国现行夫妻离婚共同财产分割法律制度所存在的无形财产被忽略、均等分割原则缺失公平、无过错方举证困难、缺少有效的财产清算制度等问题，提出完善我国离婚夫妻财产分割法律制度的建议。
