留置权制度研究
摘要：留置权作为担保物权之一，同其他担保物权一样保障着市场交易的安全。但因我国的留置权制度起步较晚，在法律实践中存在一定问题，虽然刚颁布的《物权法》对留置权制度做了一定的修改，但其中依然存在着一定问题值得完善。本文通过对留置权的法理探讨，比较中外各国对留置权的立法状况，分析《物权法》颁布后留置权制度的变化以及仍存在的问题，提出了完善留置权制度的建议。

Study on Lien

Abstract: As one kind of the security interests, the lien plays the role of safeguarding the market transaction with other security interests. But as the lien system has a late start in China, there are some problems in the practice of law. Although has been modified to some extent by the Real Right Law which was just enacted, there are still some issues in lien system needed to be perfected. Through the jurisprudence analysis into the lien and a comparative study on the legislation of lien in China and foreign countries,this article analysises the changes and still existing problems after the enactment of Real Right Law and provides it's own advices on the perfecting of lien.
